Villas de Cisnes Rental Agreement

Welcome to Villas de Cisnes! This Rental Agreement provides a clear outline of the terms and conditions for your stay at our boutique luxury resort in West Bay Beach, Roatán. It covers all essential policies regarding reservations, payments, cancellations, occupancy, safety, and more. By making a reservation or staying at our property, you agree to abide by these terms to ensure a seamless and enjoyable experience for all guests.


This Rental Agreement (“Agreement”) outlines the terms and conditions between Villas de Cisnes (“Owner,” “Host,” “we,” or “us”) and the undersigned guest(s) (“Guest,” “you,” or “your”). By making a reservation, signing this Agreement, or staying at our property, you agree to abide by these terms.

1. Reservation and Payment Policies

Reservation Policy

  • Reservations are guaranteed upon confirmation with a 20% deposit for booking completion.
  • Full payment is due 90 days prior to check-in. Failure to complete payment by this deadline may result in cancellation of the reservation.

Pricing and Fees

  • Taxes: 15% HN Sales Tax, 4% Hospitality Tax
  • Resort Fee: Includes access to amenities, grounds maintenance, guest support services, and accidental damage protection up to $1,000.

Refund Policy

  • Within 24 hours of booking: Full refund of deposit or payments made.
  • Beyond 24 hours: All payments, including deposits, are non-refundable but a credit will be applied to future stays within 12 months.

2. Check-In and Check-Out

  • Check-In: 2:00 PM
  • Check-Out: 10:00 AM
  • Early check-ins and late check-outs must be requested in advance and are subject to availability.

3. Occupancy and Use of Property

Occupancy Rules

  • Guests aged 11 years and older are considered adults for booking purposes.
  • Maximum occupancy is based on bed configuration. Inquire for details.

Event Policy

  • Events are prohibited unless explicitly approved in writing by Villas de Cisnes.

Accessibility

  • Ground-floor accommodations are available for guests with special needs. Please notify the Host at the time of booking for arrangements.

4. Lost and Damaged Items

Lost Items

  • Villas de Cisnes is not responsible for lost or misplaced personal items. However, if notified and/or found within a reasonable amount of time, Villas de Cisnes will ship items using a valid guest credit card.

Damaged Items

  • Guests agree not to hold Villas de Cisnes or the Homeowner liable for personal injury or personal property damage sustained by Guests or their invited parties.

5. Transportation and Arrival

Airport Transportation

  • Villas de Cisnes can arrange a trusted bilingual contract shuttle driver to meet you outside baggage claim. For a small additional charge, the driver may stop at a grocery store upon request.
  • One day car rentals may be arranged.
  • Guests must confirm their arrival instructions via phone, email, or WhatsApp.
  • Check-In: Upon arrival, check-in will be conducted onsite at the resort.

6. Post-Stay Inspections

  • After check-out, the Rental Manager will inspect the unit for damages, missing items, and abnormally dirty conditions.
  1. If damages, missing items, or excessive cleaning needs are identified, the Guest will be responsible for associated costs, including:
  • Repairing damages
  • Replacing missing items
  • Deep cleaning the unit
  • Guests are responsible for any damages to be settled upon departure unless covered by a damage protection plan.

7. Quiet Hours

  • Quiet hours are from 9:00 PM to 7:00 AM. Guests are expected to respect neighbors and other guests during these hours.

8. Smoking and Pets

Smoking Policy

  • Villas de Cisnes is a non-smoking property. Evidence of smoking will result in a cleaning fee - $250 USD and potential termination of the stay.

Pet Policy

  • Pets are not permitted. Unauthorized pets may result in additional cleaning fees - $250 USD.

9. Liability and Safety

Liability Waivers

  • Guests assume all responsibility for the use of amenities (e.g., pools, kayaks) and waive any liability claims against Villas de Cisnes.
  • Villas de Cisnes is not responsible for accidents, injuries, or damages occurring on or off the property during your stay.

Guest Safety

  • Guests must ensure that doors and windows are securely locked when leaving the property.
  • Personal belongings and vehicles are stored at your own risk. Villas de Cisnes is not responsible for loss or theft.
  • Surveillance cameras monitor common areas for guest safety.

Firearms Policy

  • Firearms are not allowed on the premises, except for law enforcement officers on duty. Guests must comply with all local, state, and federal laws regarding firearms.

10. Alcohol Policy

  • Guests are permitted to consume alcohol responsibly on the property. Excessive noise, disorderly behavior, or any violations of local alcohol laws will result in immediate eviction without refund.

11. Cleaning and Kitchen Use

Cleaning Policy

  • Room cleaning is included before check-in and after check-out, with mid-stay towel exchanges provided.
  • Additional or daily cleaning is available upon request for an additional fee.
  • Guests must leave the property in good condition; excessive cleaning will incur additional charges - $250 USD.

Kitchen Use

  • Guests are required to practice safe and responsible cooking.
  • Strong-smelling ingredients requiring excessive cleaning or resulting in lingering odors may incur additional fees - $150 USD.
  • For assistance troubleshooting kitchen appliances, contact staff immediately.

12. Cancellation and Force Majeure

Cancellation Policy

  • Within 24 hours of booking: Full refund of payments.
  • Beyond 24 hours: Non-refundable but may be applied to future stays at current rate of the paid amount if canceled.

Force Majeure

  • Villas de Cisnes is not liable for cancellations, interruptions, or delays due to natural disasters, government regulations, or other circumstances beyond our control.

13. General Policies

Minimum Age Requirement

  • Guests must be 21 years or older to book and stay without supervision. A valid photo ID may be required at check-in.

Dispute Resolution

  • Both parties waive the right to a trial by jury for disputes arising from this Agreement, following the laws of Honduras' arbitration.

Personal Information

  • Guest information will be protected and not shared with third parties without consent.

Waiver and Severance

  • Failure to enforce a term does not constitute a waiver. If any term is deemed unenforceable, the remaining terms remain valid.

14. Entire Agreement

  • This Agreement constitutes the full understanding between Villas de Cisnes and the Guest. No verbal or implied agreements apply unless explicitly stated herein.
